TERMS AND CONDITIONS

Introduction


A contract is formed between the Client and Matt’s Movies when a non-refundable booking fee of £100 is received and upon signing of this form. The Client may cancel this contract at any time after the deposit has been paid but will not be refunded.
Not all venues allow filming in churches/locations. It is the Client’s responsibility to seek permission and to pay associated fees.
As part of the wedding packages, Matt’s Movies supplies a music Copyright licence as required by law. If the Client wants to submit any media to be included in the film, Copyright clearance is the responsibility of the Client and will have to be arranged in plenty of time before the final video is edited.
Every attempt will be made to comply with the Client’s wishes but any final editing decisions are at the sole discretion of the editor.

 

1. General information


a. Matt’s Movies will provide services to the Client, providing the Client has assessed all the risks that may occur according to all relevant Health and Safety legislation and requirements.
b. If we have not met with you, the Consumer Protection (Distance Selling) Regulations 2000 will apply. This means you have the right to cancel your order within seven working days of receiving/reading the Terms and Conditions.

 

2. Booking and payment


a. A booking fee of £100 is required upon the signing of this form (non refundable). If the booking fee is not paid this could result in the re-allocation of the booking date to other parties.
b. A date may only be reserved once this form has been signed. Until payment of the booking fee, dates cannot be guaranteed. If a date has become unavailable because of a delay in payment any booking fee received will be returned to the sender with no further liability on either party.
c. The full balance is due 14 days before the event. Payment terms will be detailed in the invoice issued.

 

3. Cancellations and liability


The Client may cancel this contract at any time by emailing or telephoning Matt’s Movies, but once a booking fee has been paid and the booking date has been secured, the Client will not be refunded. If, for any reason, Matt’s Movies is unable to supply the product specified in the order, liability will be limited to the amount paid by the Client.

 

4. Filming the event


a. Any variations in the times, dates, or to the planned event that may impact on the contract should be communicated as soon as possible.
b. For a Wedding, the Client must obtain permission to film the Service and the Client is also responsible for any related fees that may be incurred.
c. The Client must also seek permission from any other venue where filming will be required.
d. Matt’s Movies’ speciality is discretion whilst filming. Some churches / venues do not allow filming in close proximity to the couple and this may affect sound levels.
e. Unless otherwise agreed, the Client agrees that Matt’s Movies will be the final arbiter of creative content.
f. In the unlikely event of a total video failure, we can guarantee a full refund of any monies/deposit already paid.

 

5. Film content


a. Matt’s Movies considers any special requests made within this contract, which will be included if possible. We will not be held responsible for scenes omitted due to circumstances beyond our control.
b. If a Client submits any further media for inclusion in the film, Copyright clearance is the responsibility of the Client and must be received before the event. PLEASE NOTE it is the Client’s responsibility to contact the photographer in order to ensure that any desired still photographs are forwarded to Matt’s Movies before the final product is completed.
c. Completion is usually within one month from the date of the event but only after the Client has supplied Matt’s Movies with all items required to complete the video.
d. The format of the final product is DVD-R unless the Client specifically requests a different format.

 

6. Copyright


Matt’s Movies owns the Copyright to all finished products. As such, the Client agrees that the product or any part thereof may be used as part of any promotional material related to Matt’s Movies. The Client must seek permission for the inclusion in the finished product of any copyright media supplied by the Client. The Client must take full responsibility if any claim is brought about against Matt’s Movies relating to breach of Copyright relating to media supplied by the Client.

 

7. Data Protection


It is the responsibility of the Client to ensure that permission has been granted from parents/guardians of any child appearing in the final product.

 

8. Lost or damaged property


Matt’s Movies will endeavour to ensure the safe handling of any property belonging to the Client but is not responsible for any loss or damage to that property while Matt’s Movies has it in its possession.

 

9. Further Information


a. You may order further copies up to 12 months after the event. Beyond that time, the master copy may no longer be available.
b. Any complaints must be received in writing no more than two weeks after receiving the final product.
c. These terms and conditions and the contract are governed by the law of England and Wales, and considered exclusively by the English and Welsh courts. The Client hereby allows Matt’s Movies to display media included in this contract in any form.
